Carrying out works on a property can impact not only the owner, but also the rest of the building and condominium owners. Therefore, it is essential to pay attention to certain legal aspects.
Therefore, if you are thinking of doing improvement works, pay attention to the following:
According to the platform, due to the noise caused by the construction works, they are only allowed to be carried out on weekdays, from 8 AM to 8 PM.
"Although this type of work carried out inside residential, commercial, or service buildings is not subject to the issuance of a special noise license, according to the General Noise Regulation, we advise you to post information in a location accessible to the building residents with the estimated duration of the works and their scheduled hours," it can be read.
Since the rubble caused by the works may require a permit to occupy the public road, you must contact the City Council to understand the need to place containers or material deposits, scaffolding, or hoardings. The municipality itself may indicate the disposal of the waste caused by the works.
There are some situations in which a license from the Chamber is required, such as changing the facade of a building like "increasing it, changing the number of floors or painting it, a licensing request must be made to the Chamber. But if it is just a touch-up in the painting, the same is not required and you do not need to inform the municipality", explains the Idealista.
A license may also be required if you want to enclose a balcony and turn it into a marquee, depending on the municipality where the property is located. You should inquire with the respective local authority. However, in the case of a building in horizontal property, the alteration will always have to be authorized by the condominium by a majority of two thirds.
And a construction license may still be required if rebuilding a house in ruins, if the property or building in question is located in a protection area of classified properties or in the process of classification.
According to the platform, these are the situations in which you do not need to request a license: roofing works, demolishing interior walls, installing solar panels, and building a swimming pool.
You must be aware that, if you do not obtain a license for the necessary cases and proceed with the construction anyway, Portuguese legislation imposes fines in case of violation ranging from 500 to 200 thousand euros.
"In cases where a license from the municipality is required, the work may be monitored at any time without prior notice, although this monitoring is limited to the site of the work specified in the license," warns Idealista.
Note that a contract may still be required, according to the law in Portugal, in case the works exceed a budget of 20 thousand euros, in order to include the identification of the parties, licenses, the work to be carried out and respective materials to be used, total value of the work, deadline for completion and penalties in case of delays.
